TARION Pre-Conciliation Inspection

We scheduled a TARION conciliation inspection earlier, and paid the mandatory, refundable, deposit.

The TARION inspector called today, outlining what will happen during the inspection. I asked if he was going onto the low-pitch roof to inspect its construction to verify it is in accordance or if it contravenes with the TARION Construction Performance Guidelines. The inspector said "No, we are not insured for that. The onus is on the homeowner to prove that the roof construction does not meet TARION Construction Performance  Guidelines."

Excuse me?!?

One must pay a mandatory fee to TARION to obtain the rights and privileges provided to the homeowner through this TARION New Home warranty program, yet the homeowner must prove that an item doesn't meet TARION's CPG's. An item such as a roof, which the general homeowner will have zero lack of knowledge concerning the proper installation of shingles, flashing, roof vents etc.

We're not talking about a simple nail-pop, we're talking about a roof leak which leads to water penetrating the building envelope. Water! Something you do not want entering the building envelope in an uncontrolled manner.

The inspector informs me over the phone that the claim will go in Minto's favor due to a lack of proof. A leaking ceiling is not proof enough, it's a homeowner's maintenance issue. I asked that since the roof vent is only about 3" tall, and we routinely receive snowfalls equal to or greater than that amount, was I expected to climb onto the roof to clean it each time. In a round-about Tarion-speak his answer was "yes".

Well fantastic ! Thank you for informing us.
